Lanane bills advance in General Assembly
INDIANAPOLIS, IN – Midway through the 2008 Indiana General Assembly, the Senate has approved seven pieces of legislation authored by Tim Lanane, D-Anderson. This includes Senate Bill (SB) 171, a measure that would allow a victim’s disability to be considered an aggravating factor in future criminal sentencing. The bill, which received support from disability advocates, specifies that the defendant would need to have known or should have known that the victim was a person with a disability at the time of the crime. The bill passed the Senate 48-0.
Other Lanane measures that have received Senate approval include:
SB 27 would mandate an eight-hour cooling off period in custody for individuals arrested for domestic battery. According to the Indiana Coalition Against Domestic Violence, 76 deaths were attributed to domestic violence in the state between July 1, 2006 and June 30, 2007. This bill would give families the time they need to access services. The bill passed the Senate 48-0.
SB 45 is a measure to implement an interstate agreement to protect and cooperatively maintain the Great Lakes. This bill would ratify the Great Lakes Compact in Indiana. SB 45 passed the Senate 47-0.
SB 89 would require the equitable owner of a loan brokerage business and any applicant for registration as an originator or a principal manager to submit fingerprints to the Indiana Securities Commission. The bill would authorize the Commission to include a national criminal history background check as a licensing and registration requirement for loan brokers, originators, and principal managers.
The bill also increases regulation for certain actions in connection with a contract for the services of a loan broker, including receiving funds that were known to be generated as a result of a fraudulent act or filing any document that contains an untrue statement or that omits a material fact with a county recorder. The bill was recommended by the Interim Study Committee on Mortgage Practices and Home Loan Foreclosures and was approved by the Senate by a vote of 48-0.
SB 208 would allow counties to establish a voluntary program for taxpayers to pay property taxes by automatic deduction from a checking account, a system now used by many individuals to pay other monthly bills. Counties would also benefit by receiving a constant flow of income and avoid the necessity of year-end borrowing. The program would be available based on county-by-county approval. This bill passed the Senate 47-1.
